District attorney reopens case of alleged Cornell University 'gang rape' - "Prosecutors in central New York say they are reopening the investigation of an alleged "gang rape" at a Cornell University fraternity in 2024 after a civil lawsuit filed earlier this month sparked outrage about the incident. Tompkins County District Attorney Matthew Van Houten said in a statement that his office is considering whether to bring criminal charges related to the incident, though he said the allegations in the civil complaint are "dramatically different" than the woman's statement to police two years ago... The reopening of the case comes less than two weeks after a former Cornell student filed a civil lawsuit alleging that she was drugged, assaulted and gang raped by seven former and current members of the Chi Phi fraternity at Cornell. Cornell's Chi Phi chapter was barred from campus after the alleged Oct. 19, 2024, incident, though none of the individuals allegedly involved faced criminal charges, according to the DA. Van Houten said his office did not bring charges in 2024 because the woman's statement to authorities did not allege she was drugged without her knowledge or that she did not consent to engage in sexual activities. "She never says that she was drugged without her knowledge. She admits to taking drugs and alcohol voluntarily and with knowledge. She does not allege that she was forced to engage in any acts. She does not say that she was physically helpless or unconscious or incapacitated at any point during the time at the fraternity house," Van Houten said. Van Houten said that he considered Jane Doe, the alleged victim, credible. He also said neither Jane Doe nor her attorneys ever contacted his office to ask for reconsideration of her case or to suggest that her sworn statement was inaccurate... According to a summary of the six-page typewritten statement Van Houten said Jane Doe provided to the Cornell University Police Department in November 2024, Jane Doe told police that she agreed to have a threesome with two Chi Phi fraternity brothers in part "due to how attracted [she] was" to one of them and in part because of her "drunken curiousness." The statement goes on to say that Jane Doe and the two fraternity brothers then "engaged in a 'threesome'" involving sexual activity. Another man then entered the room and shook her hand, according to the document. "When [Jane Doe] made contact with [Male Number 3's] hand, [Male Number 3] pulled [Jane Doe] into him and [they] began making out. While [Male Number 3] was kissing [her], [Male Number 2] began groping [her]. Eventually, [Male Number 2, Male Number 3, and Jane Doe] would end up on the bed next to where [Male Number 1] was sleeping and [they] began to have a threesome," the document said. Other men were also in and out of the room, according to the document. "Jane Doe had difficulty remembering parts of what happened next. She remembered '[Male Number 7] said something very rude and mean to [her].' Male Number 7 apologized and 'grabbed [her] face and started kissing [her].' Jane Doe 'quickly backed away to stop [Male Number 7] from kissing [her],' according to the document. The summary then said some of the fraternity brothers began complimenting Jane Doe's looks and asked if they could ingest drugs off of her body. "While the men were doing drugs off of her body, [Male Number 3] and [another male] entered the room and said something like, 'Ok we're shutting down whatever the [expletive] this is,'" the document said. "While the behavior of certain Chi Phi fraternity members was without question disgusting and morally reprehensible, the foundation of the criminal justice system is that criminal prosecutions must be based upon evidence and not emotion," Van Houten said."

I cannot purport to know what happened one night at a frat house in October 2024—any more than you can. However, here are a few basic principles much of the public appears not to understand. A lawsuit is a series of allegations made by the plaintiff. It is not proof. Allegations made in lawsuit turn out to be untrue all the time, either due to mistake, intentional misrepresentation, or flat-out lies. Unfortunately, people often misrepresent the truth in lawsuits due to monetary and other incentives. In the past, there have been instances of fabricated rape allegations. About a decade ago, Rolling Stone published a piece about an allegedly horrendous rape that occurred on the UVA campus that garnered similiar outrage to this incident and turned out to be entirely fabricated. I have read the DA’s press release and the lawsuit itself. According to the cited portions of Jane Doe’s statements to police shortly after the incident, crediting it as entirely true, there was simply no basis to charge the alleged perpetrators. Everyone involved was apparently extremely intoxicated. Jane Doe gave consent to the encounter at the beginning and does not explicitly recall any activity occurring after consent was withdrawn. It is possible that, due to her inability to recall, she had not given consent for some of the activity towards the end, but possible is not a basis for a district attorney to file criminal charges. Her current lawsuit is fairly consistent with her initial statement—except it omits the portions where she told the police she gave consent. Is she lying? Did she later remember something she didn’t initially? Is she mistaken? I do not know—and again, neither do you. What I do know is that if we are to live in a society of laws, going after the jobs and reputations young men who may have participated in an entirely consensual incident, and the DA who made the correct decision not to charge, is mindless mob justice. We actually want prosecutors to decline to seek indictments when there’s insufficient evidence of criminal wrongdoing. None of this is to say I approve of what happened as reported in the initial statement to police. That’s a cultural and parenting issue, though, not a matter for law enforcement. I encourage people to let the DA’s office handle the case going forward, and not to participate in the witch hunt against either the prosecutors involved or the young men who, as of now, have not been charged or shown to have committed any crime."

The most important point though, is that destroying people's lives based on allegations to police, in a lawsuit, or elsewhere is extremely dangerous. It is exactly why civilized societies should not engage in the modern equivalent of witch trials, and people should decline to rush to judgment. The way this story has changed over mere days is a near perfect lesson in why we shouldn't call for people's heads simply because disturbing accusations have been made. Of course, no one will actually learn anything and nothing will change, regardless of how many times this sort of thing happens, because apparently as a nation, we are incapable of actual progress. I intend not to comment on this case again absent extraordinary developments, because my primary interest is not in determining one way or the other what happened, but in urging people to resist the temptation to engage in mob justice to the point law enforcement officers are acting at the public's direction. I believe that point has been made, although of course it won't satisfy the bloodthirsty."

2) is it "drunk?" "too drunk to consent"? how do we define those terms?
3) How is the alleged perpetrator supposed to know, subjectively, how drunk the alleged victim is? A person can be quite drunk and/or high and appear relatively sober and state that they are consenting (as actually happened here).
4) what if both parties (or, as in the Cornell case, multiple parties) are intoxicated? are they all raping each other? Should prosecutors seek indictments against all of them?
5) are we prepared for a system in which anyone who has consumed any alcohol can make a rape allegation?
Have the "loophole" people thought this through? Because we're now looking at a world where anytime one party has a drink (or the number of drinks needed to constitute whatever definition of rape we end up with in answer to questions (2) and (3)) and is angry at their sexual partner, regretful, or jealous, s/he can make a rape allegation and presumably get their current former sexual partner behind bars. Part 1: Jane Doe walks 1 mile to the Chi Phi FRATERNITY House in Ithaca, NY on Cornell University. She's already drunk at a level of 5 out of 10, by her own account. She walked there, because she had been exchanging text messages with male number 1 prior to the meet up. When she arrived, she immediately opened an unopened can of beer and drank it, despite being already 5 out of 10 Drunk. After some dancing with Male 1, he led her to a quiet room, and asked for her consent to engage in a threesome with a second male partner (Male 2) She agreed and GAVE CONSENT. She even remembers being EXCITED at the idea of it.
Part 2: After Drinking that additional beer upon immediately entering the Chi Phi FRAT House at Cornell University, Jane Doe reports feeling 6 out of 10 drunk, agreeing to the threesome with Male 1 and Male 2 and in her words she remembers being "Pretty ok with having this threesome." Jane Doe pats him on the back and tells him if he needs to vomit, he should. She also simultaneously makes sure to wake up Male 1 periodically, to ensure that he's still ok. Male 3 then eventually enters the Frat House. he lives there. He introduces himself to Jane Doe, and begins making out with her. Eventually Male 2 and Male 3, wind up on the bed right next to Male 1 who's napping, and Jane Doe engages in a SECOND Threesome with Male 2 and Male 3, while Male 1 sleeps besides them.
Part 3: Male 1 wakes up during the course of this threesome between Jane Doe, Male 2, and Male 3, and requests to join in and make it a foursome. Jane Doe DECLINES, because it would require anal sex, which she was opposed to. Jane Doe then remembers Male 3, actually disengaging from the threesome, and leaving the room all together. Part 5: Shortly after, Male Number 1 (The original male of the Cornell 7 that Jane Doe was there to see) and Male number 4, usher Jane Doe out of the initial room this all took place in, and head upstairs to a more private room. Male 1 then states to Jane: "Let's do More ketamine." Jane Doe agrees, and snorts more Ketamine. Then Male 1 says he wants to have sex again to redeem himself over the fact that he passed out earlier that night. Jane Doe then engages in a threesome with Male 1 and Male 4. But a person who is intoxicated obviously reserves the right to revoke consent at any time. And if a person passes out, then consent is withdrawn. The law does not allow for an intoxicated person to be subjected to sex despite their objections. This situation is rapidly spiraling out of control, and the prospect that actual justice will be served—by James and Hochul—seems vanishingly unlikely."
