Amy Hamm: No MAGA beliefs allowed at Parks Canada historic sites - "the only thing kitschier than a MAGA hat inspired by U.S. President Donald Trump is the fanatical anti-MAGA sentiment that has some Canadians behaving like the jealous stepchild sibling to our southern neighbour. That is certainly how several residents of Nova Scotia are acting after discovering that a so-called “MAGA influencer” and musician, Sean Feucht, had booked a show at the York Redoubt National Historic Site for Wednesday night. Their outburst about Feucht led Parks Canada to revoke his permit late Tuesday over “evolving safety and security considerations.” The musician has since secured a new location in rural Nova Scotia... Feucht is not my cup of tea. At all. But the marvellous part in all of this is that no one is forcing me to attend any of his shows. Nor is anyone else being forced to attend. Not a single Nova Scotian will be dragged, kicking and screaming, to the Parks Canada site, or any other site where Feucht will presumably crow about the gospel and the Grand Old Party. How great! Nevertheless, several Nova Scotian residents garnered media attention after decrying the planned event. Not content to merely express their intolerance of Feucht’s views, they want the whole show cancelled. Shut ‘er down. They damn near succeeded. Their level of perturbation is hokier than a bright red “MAKE AMERICA GREAT AGAIN” cap. At least with the cap, one is merely expressing oneself — and not also trying to control what others can see, hear, think or do. More outrageous, still, is that Shannon Miedema, Liberal member of Parliament for Halifax, attempted to do the bidding of her censorious, anti-freedom constituents. According to CBC News, the outlet was shown a message that Miedema emailed a resident, which reads: “I have the utmost respect for the value of free speech, I do not believe this event aligns with Parks Canada’s core values of respect for people, equity, diversity and inclusion, or integrity.” A bit like a vegan preaching the “utmost respect” for the value of not consuming animal flesh while munching on a medium-rare steak, no? Miedema, Miedema. Allow me to give you a lesson on free speech: it necessitates allowing others to speak, even when you dislike (or think you will dislike) what they have to say. This is basic, 101-level stuff. Listing off “diversity, equity and inclusion” within a vague statement on harm or “integrity” to suppress others’ speech has become a predictable — and equally pathetic — trope of the far left. These characters, Miedema included, have yet to realize that to the average Canadian, being cancelled is now widely considered a badge of honour. We’ve grown tired of wokescolds... Unfortunately for all those who’ve come down with a wrist-spraining case of handwringing over Feucht’s upcoming show, it remains legal in this country to hold, and share, opinions on contested topics. Yes, even about abortion, gender and race — and even if one identifies as a MAGA supporter while doing so. It’s difficult, clearly, but these disgruntled pseudo-patriots are going to have to wipe the tears from their faces using Canada’s Charter of Rights and Freedoms."

All six Canadian venues cancel Christian musician Sean Feucht’s shows - "The City of Vaughan, Ont., where Feucht was to have finished the first leg of the Let Us Worship: Revive in 25 tour on Sunday afternoon at the Dufferin District Park, confirmed to National Post that it had cancelled the special event permit “on the basis of health and safety as well as community standards and well-being.” Municipalities and venue management offered similar justification for cancelling Feucht’s shows at five other venues in recent days... The show did proceed, albeit 70 kilometres northeast from its original site, when a farmer in Shubenacadie opened up his field. A video shared to Feucht’s social media channels show farm equipment knocking down tall grass to make space for parking. The City of Charlottetown, also citing “evolving public safety and security concerns,” had already cancelled a Thursday morning show scheduled for Confederation Landing... P.E.I. Liberal MP Sean Casey had also called for the show to be cancelled. “While I fully respect the right to freedom of expression, I do not believe this event reflects the values of inclusivity and respect that define the City of Charlottetown or the Government of Canada,” he wrote on Facebook. Feucht’s Thursday show at Moncton’s Riverfront Park was also cancelled the day prior after the city deemed it didn’t comply with its facilities’ code of conduct and represented a “potential risks to the safety and security of community members, event attendees, and organizers.”... Also axed on Wednesday were Feucht’s scheduled performances in Quebec City and at the Jacques-Cartier Park North in Gatineau, overseen by the National Capital Commission, which cited “concerns about public safety and security” in a statement to National Post. Meanwhile, François Moisan, Quebec City’s director of public relations, specified in an email to National Post that the contract to perform at ExpoCité on Friday evening was cancelled because “the presence of a controversial artist was not mentioned when the contract was signed.”... “Here’s the hard truth: If I had shown up with purple hair and a dress, claiming to be a woman, the government wouldn’t have said a word,” he wrote. “But to publicly profess deeply held Christian beliefs is to be labelled an extremist — and to have a free worship event classified as a public safety risk.” He went on to explain that his Let Us Worship movement was created in response to COVID-19 policies, which in Canada, “were among the most oppressive in the world.” “The pandemic may be over, but the anti-Christian bias remains.”"

Free speech is the right to say horrible things - The Globe and Mail - "Senator Kristopher Wells tweeted that Mr. Feucht has “no Charter right to have his shows hosted at public facilities, which must be safe and discrimination-free spaces that uphold community standards.” The senator should brush up on constitutional law. The Charter does not mention “safe and discrimination-free” public facilities or “community standards.” It does state that: “Everyone has the following fundamental freedoms: (a) freedom of conscience and religion; (b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication; (c) freedom of peaceful assembly; and (d) freedom of association.” Of course, the Charter lays out legal limits to those freedoms. And the Criminal Code prohibits hate speech. To our knowledge, Mr. Feucht has not said anything during his Canadian tour that rises to the level of criminal hate speech. If so, the remedy is clear: criminal charges, not prior restraint. Nor have federal officials refused him entry to Canada on one of many the admissible grounds. As for the “community standards and wellbeing” that the City of Vaughan, north of Toronto, cited in rescinding Mr. Feucht’s permit, we would all do well to remember that Vaughan and other communities contain houses of worship representing faiths that embrace at least some of what Mr. Feucht preaches. Popes, for example, have often spoken in Canadian public spaces despite the opposition of the Roman Catholic Church to abortion and same-sex marriage. If anyone finds Mr. Feucht’s preachings offensive, there is an excellent way to show displeasure: through legal, peaceful protest. Or by simply ignoring him."

In the 1940s the Quebec government used municipal and provincial administrative actions to censor Jahovahs Witnesses and the SCC declared that these actions were an infringement on free expression (this was before the charter existed, so it wouldn't have been a section 2 violation specifically, but unconstitutional based on the understanding of the uncodified constitution at the time). I couldn't care less about Feucht, but I nonetheless hope someone sues some of these municipal governments for their very obvious charter violations which should hopefully discourage more actions like this in the future."

Without property rights, free speech is hard - "When a church generously offered Feucht a last-minute change of venue, it was targeted by a police raid for daring to allow people to express themselves without a permit. The right to speak and think requires the right to risk offence. Shutting down speech to accommodate threats of violence and destruction from disingenuous “protesters” plays right into their authoritarian hands. The Charter of Rights and Freedoms also protects the right to freedom of peaceful assembly and freedom of association — rights that were obviously in play in these cases. So, what gives? The very first clause in the 1960 Canadian Bill of Rights protected the “enjoyment of property, and right not to be deprived thereof except by due process of law.” But, while almost the entirety of the Bill of Rights was incorporated into the Charter in 1981, the clause protecting property was conspicuously deleted. In 1988, the House of Commons passed a resolution to rectify this failure. But it expired in 1991, after failing to receive the necessary endorsement of provincial legislatures... in modern-day Canada, the government has taken all our sticks and makes us apply for permits to use them, or taxes us almost into oblivion when we do. If you can’t express yourself on public property without government approval, and you can’t express yourself on your own property without government approval, an abstract right to “free expression” is meaningless"
