"A Difficult Moment at an Interfaith Event. Yesterday, City College hosted an interfaith program intended to bring students of all backgrounds together in dialogue and mutual understanding. Unfortunately, what unfolded was deeply troubling for many who attended. During the program, one of the invited speakers-an imam-refused to begin his remarks while I was present, stating that he would not speak "in front of Zionists." His comments quickly escalated into inflammatory and openly antisemitic rhetoric, including statements about "cutting off the fingers of the rich," along with other remarks that had no place in a space intended to foster respect and learning. Instead of an interfaith dialogue, the speech shifted into conversion-style message that made many attendees, Jewish, Christian, and Muslim alike, deeply uncomfortable. Freedom of expression must not become a right to harass or intimidate - The Globe and Mail - "I watched video of masked protesters roaming the same streets in north Toronto, leaving many residents fearful of leaving their homes.  These protests – which appear to be thinly veiled efforts at intimidation or harassment – target Jews where they live. They’re not aimed at a government office, an institution, a public event, or a high-profile personality; rather, they seem to be targeting individuals based on their religion or political beliefs. The unmistakable signal is that their mere presence in the community is worthy of protest, which in turn requires a persistent police presence just to maintain public safety.  This is hardly the first time that Canada has experienced intimidation or harassment on our streets and community spaces based on race, religion or political beliefs. In 2017, the Soldiers of Odin, a far-right group founded by a self-proclaimed Nazi that originated in Finland, began appearing in Canada, conducting patrols in public spaces and harassing counter-protesters. Soon after, there were anti-Muslim and anti-immigration events in major cities across Canada.  Those events rightly sparked calls for action. For example, the National Council of Canadian Muslims (NCCM) released dozens of recommended policy reforms, including demands that provincial governments mandate that municipalities “pass bylaws to combat and deter street harassment.” It also called on municipalities to pass bylaws that address “hateful verbal assaults and give authorities the ability to ticket and fine when necessary.”  The NCCM is no longer a vocal advocate for such measures, however, and opposes bubble zone bylaws that restrict protests near vulnerable institutions such as hospitals, schools, places of worship, and senior homes. The bylaws, modelled after laws designed to restrict protest near abortion clinics that were upheld by Canadian courts as a reasonable limit on expression rights, have emerged in cities such as Toronto, Vaughan and Ottawa as officials search for answers in response to repeated incidents of hate and intimidation. The principle is also found in Bill C-9, the federal government’s Combatting Hate Act, which is currently being studied in the House of Commons. It features several measures, including a new provision against intimidating or obstructing access to religious or cultural places. This approach is a useful start, but it does little to address the even more pernicious act of harassment or intimidation in residential neighbourhoods where the targets are everyday people rather than places.  Canada rightly protects freedom of expression and assembly as fundamental Charter rights. But while the speech is protectable, there must be consequences for those with the intent to harass or intimidate others based on their religion or political beliefs... Vulnerable groups have supported a range of alternatives in the past: public-order measures to restrict the location of protests, trespass notices and anti-harassment bylaws, which include noise, disruption and targeted harassment, to deny protest permits. Where the situation escalates, such as during a recent incident near Toronto Metropolitan University, the Criminal Code can be used for offences such as assault, forcible entry, unlawful assembly and obstruction.  None of these measures should be particularly controversial. They all aim to balance expression rights with the right to be free from intimidation and harassment. Yet too many politicians have stayed on the sidelines for too long."

He is now working as a full time Graduate Teaching Fellow.  Tettey Tamaklo completed an anger management class and 80 hours of community service through a pretrial diversion program. Harvard never disciplined him beyond removing him as a freshman proctor. The school refused to cooperate with prosecutors and kept him in good standing throughout the case.  Harvard also rewarded the second student charged in the assault. Ibrahim Bharmal received a sixty five thousand dollar Harvard Law Review fellowship and is now working at CAIR Los Angeles.  The Israeli student who was assaulted is suing Harvard, saying the university obstructed the investigation and prevented any administrative remedy.  Harvard’s message could not be clearer. Harm a Jewish student and keep your politics aligned with the right people, and the institution will protect your future rather than hold you accountable.  Higher education in the United States is a cesspool of hatred and violence with absolutely no accountability.  Via @elianayjohnson"

Pro-Palestinian Protest Turns Violent at Wilshire Boulevard Temple Event - "Jolkovsky, who is also a Jewish activist with 30,000 followers on Instagram, asked one of the demonstrators why they were protesting in front of the synagogue.  “We are protesting in front of a site that holds genocide supporters, and they are trying to bring it to K-town,” said the masked woman.  Wilshire Boulevard Temple is a historic synagogue located at 3663 Wilshire Blvd. in Koreatown. Founded in 1862, it is the oldest synagogue in Los Angeles.  Inside the historic temple that morning there was a lecture for the Korean community.  “We couldn’t hear the speakers because they were chanting so loudly outside,” said Jolkovsky in a phone interview with the Journal. “The event was done in coordination with the Korean community. I was very shaken up. The Koreans in the group were even more shaken up than we were and said to us, ‘So this is what you experience?’”  The lecture that day was meant to promote bridge-building, learning, and dialogue between the Israeli, Jewish, and Korean communities where the historic temple is situated.  “It was meant to teach the Korean community the safety strategies that the Jewish community uses when facing hate crimes and the surge of antisemitic rhetoric,” said Jolkovsky. “We wanted to unite the Jewish and Korean communities and share our knowledge with them because there is still anti-Asian hate.”  The lecture started at 9:30 a.m., but about an hour and a half into the event, two females in the audience suddenly stood up and began yelling.  “They screamed anti-Israel phrases at the top of their lungs,” recalled Jolkovsky. “Everyone told them to get out, this is not the place. We said there are children downstairs at the nursery and this is a place of worship, but they didn’t care.”   Security soon escorted them out, but seconds later, out of the blue, Jolkovsky heard the sound of shattering glass. One of the protesters, who had pretended to come for the lecture, smashed a glass vase inside the synagogue before being taken out as well.  The shards of broken glass nearly hit Jolkovsky and others in attendance.  “There were pieces of glass everywhere. It seemed like some protesters entered through different doors and pretended to be part of the event, but this guy smashed a glass vase and it shattered all over the floor. He said, ‘Genocidal terrorist, s**k my d—k,’ and other profanities.  “Security took him out, and then another girl started yelling about dead babies in Palestine. I turned around and saw that the wall behind me was all windows, and there was a man with a baby strapped to his chest and a stroller in front of him. He was yelling at us, and his toddler was scared and crying and didn’t know what was happening. It was really cowardly to hide behind his baby.”

So, those accusing Israel of genocide must prove their claim to the highest standard possible in the law.  But sure, happy to oblige.  Every single accusation has failed to establish intent as required by law. That intent threshold is known as “dolus specialis” and is an extremely high bar to meet. It requires that you prove that the conduct you accuse them of is the conduct the accused intended to commit. (Side note: those experts you cited argue to shift from dolus specialis, which is the codified law, to dolus eventualis, which is not the codified law).  Every accusation cites to Netanyahu’s reference to “remember what Amalek did to you” from Deuteronomy. That reference is found in The Hague on the Holocaust memorial and is a culturally important reference after a massacre of Jews. Under the Tolomir case from ICTY it would fail to establish intent because you’re required to place that into context.  Every accusation cites to Gallant’s “we are fighting human animals” statement but each has ignored that it was a direct reference to Hamas, which is not protected in the Genocide Convention. Again, failing the ICTY test.  Every accusation cites to Herzog’s “no innocents” statement but neglects, again, his saying in the same speech that civilians must be protected. Again, failing the ICTY test.  Next, we should assess the harm. In Gaza it’s about 3% of the population having been killed (including combatants). In every genocide that’s been adjudicated it’s a range of 20-80% of the population decimated in about a month to years. This is true for the Holocaust, Srebrenica, and Rwanda. This fails the second prong of the test.  Next, we should assess if a protected group has been systematically targeted for destruction. Here, again, we have 3% of the population having reportedly been killed (so far), of that at least 1/3 are combatants. This was done in a complex urban environment where a combatant party (Hamas) systematically embedded and fought from civilian and humanitarian infrastructure. This causes us to expect higher civilian casualties because provisions of law such as GCIV 19 & 28, and API 51(7) then apply expressly not immunizing the combatant party operating the way Hamas does from harm. Essentially, saying places where civilians are become targetable. Thus, this defeats the third prong of the analysis.  Finally, we need to have demonstrated the conscious planning of the alleged genocidal actus reus. An example of this is the Nazi’s Wannsee Conference. Here, we have the opposite. When a plan of action threatened the safety of Palestinians and was called into question on legality, the plan was scrapped. Demonstrating that there was no conscious planning of a genocidal actus reus and legal mechanisms operated to ensure compliance with the. This defeats the fourth prong of the ICTY’s Tolomir analysis.  Since the ICTY Tolomir analysis cannot be sustained to infer intent, you cannot establish that genocide has occurred.  As a lawyer who actually practices this area of law, and not a keyboard warrior or historian who has mangled the law for ideological bias, I find it prudent to actually apply it objectively and honestly.  Hope this helps, Johnny."

Carlos Portugal Gouvea, 43, copped Nov. 13 to a single charge of illegal use of the air rifle in connection with the Oct. 2 incident outside of Brookline’s Temple Beth Zion, which took place on Yom Kippur, the holiest day in Judaism...
